| NOTICE TO ALL VENDORS AND PURCHASERS - TERMS AND CONDITIONS OF SALE |
1. All Vendors and Purchasers will be deemed to have full knowledge of the conditions hereon and the Purchaser to have heard and understood the Auctioneers description of the Lot offered. |
2. The Auctioneer may, without giving any reason whatsoever, refuse to accept either Entry or bidding from any persons or person. |
3. The Auctioneer may withdraw any Lot or Lots either personally or through any other person and many times as they think fit. |
4. The highest bidder for each Lot shall be the Purchaser thereof save that, In the event of a dispute arising as to the final bid, the Lot shall be immediately put up for sale again at the last undisputed bidding. |
5. No person will advance less at a bid than the sum to be named from time to time by the Auctioneer. |
6. No Lot shall be transferred to another person before the Purchaser has made full payment for the Lot. |
7. Neither the Vendor or the Purchaser of a Lot shall have any remedy against the Auctioneer is respect of the Lot. The Auctioneer acts as an agent only in inviting bids for the Lot, but will supply names and addresses of principals on request by either party in the event of a dispute. |
8. Any Lot brought in by any person other then the owner will be treated as a Sale and commission charged. The Auctioneer reserves the right to accept bids from the Vendor or to bid on his behalf up to the reserve price. |
| 9. If any Purchaser fails to comply with any of these conditions or with any other conditions shown hereon, the Lot or Lots in respect of which such failure is made, may, if the Auctioneer thinks fit be put up again and resold. If upon such resale a lower price is obtained for any of such Lots than was obtained on the first sale, the difference in price plus all additional expenses shall be a debt due from the Purchaser in default upon the first sale. |
10. Sales can be made privately, providing that the animal has first been offered by auction and an agreed fee is paid in to the office and a receipt is obtained. Any person, both buyer and seller failing to do this will be refused any further business and not allowed on the sale ground, and commission will be claimed on the reserve price of the Lot. |
11. Persons buying or selling a Lot privately must satisfy themselves that commission has been paid to the office, otherwise the Lot in question will not be allowed to be taken from the sale yard until commission has been paid. |
12. The Auctioneer does not give any warranty as to the seller's title or good right to sell save that the entry has been accepted by the Auctioneer in good faith and without express knowledge of any defect in the Seller's title. |
13. All entries sold with warranty, rigs, crib-biters, defects in wind and eyes, must be declared by the Vendor and must not be lame otherwise the Lot can be returned by the Purchaser by 2pm on the day following the sale. This applies to Lots sold for 51gns up to 250gns. Lots sold for 251gns upwards have until 2pm on the 2nd day following the sale. All Lots sold for 50gns and below, no matter how described are automatically sold without warranty and are non Returnable. |
14. All complaints regarding Lots sold with a Warranty must be notified by phone: Tel. 01638 780680 Office hours or Evenings and Weekends within the Warranty time as Rule 13. These times must be strictly adhered to. |
15. Complaints made after the time stated or persons not authorised will not under any circumstances be entertained and the Purchaser will be bound to keep the Lot and will have no claim for damages or otherwise against any person in respect of the Lot. |
16. In the event of a complaint on any Lot and such complaint being upheld then the Lot must be immediately returned to the Auctioneer's premises at the sole cost of the Purchaser. No allowance will be made for the cost of transport or feed. Should qualified Veterinary opinion be required to settle any dispute, then payment for the opinion shall be recoverable from the person proved by the Veterinary to be wrong or at fault, should arbitration be required to settle any dispute. |

19. Any Lot taken from the sale before payment will be treated as stolen and the matter reported to the Police. |
20. Each Lot shall be entirely at the owners risk immediately the Lot entering upon the Auction premises and shall be at the Purchasers risk immediately upon the fall of the hammer. The Auctioneer and his staff will not be responsible for loss or injury or death of any animal or article on the sale premises. |
21. Payment will only be paid to the person who has entered the Lot in the sale and transfer to other persons will not be recognised. Purchasers must make full payment for Lots purchased and transfer of Lots to other persons before payment will not be permitted under any circumstances. |
22. Not withstanding a Lot having been knocked down to a Purchaser at the Auction neither the ownership nor the possession in the Lot shall pass to such Purchaser until the full purchase price has been paid including clearance of a cheque. |
23. Should a horse not be sold by the Auction, the Auctioneer reserves the right on the sale day to negotiate the sale of that Lot by private treaty to any interested party at the reserve price of the Lot without reference from the Vendor. |
24. All Vendors will be deemed to have full knowledge of the Auctioneer rates of commission, which are obtained from the Auctioneer or the entry office. Full commission will be payable by the Vendor in respect of any Lot returnable under the conditions in respect of complaints and any subsequent arbitration. |
25. Vendors will be paid out immediately once purchasers cheque has been cleared by the bank and the Lot or Lots in question are not involved in any dispute. |
26. Ill treatment of animals will not be tolerated therefore the use of whips and sticks are prohibited. |
27. All Lots must be cleared from the premises on the day of the sale unless alternative arrangements have been made with the Auctioneers. |

29. The description and pedigree of horses are supplied by the Vendor, who alone are responsible for their accuracy. |
30. Any horse arriving on the sale premises without a passport will be ID on the day and a passport applied for at the expense of the vendor. |
IN ALL CASES CRIB-BITERS, WINDSUCKERS AND WEAVERS MUST BE DECLARED. |
